PROPOSED AMENDMENT
OF THE STATUTORY
MEASURES RELATING TO
MAIZE PRODUCTS,
WHEATEN PRODUCTS AND
ANIMAL FEEDS
(Comments due by 7
March 2014)
The National
Agricultural
Marketing Council (NAMC)
has published a
document entitled “Application
for statutory
measures
(registration,
records and returns)
relating to maize
products, wheaten
products and animal
feed, in terms of
the Marketing of
Agricultural
Products Act 47 of
1996”.
Notice 103 of 2014
has been published
to invite comments
from directly
affected groups in
the grain and
oilseeds industry to
forward comments
regarding the
request from the
maize and wheat
forums.
The notice has been
published in
response to a
request received
from the maize and
wheat forums, on
behalf of directly
affected groups in
the grains and
oilseeds industries,
for the introduction
and promulgation of
statutory measures
such as registration
and the keeping of
information and
submitting monthly
returns in respect
of the products in
question.
In terms of the
proposal the South
African Grain
Information Service
(SAGIS) will be
responsible for the
registration,
collection,
dissemination and
distribution of the
information
associated with the
statutory measures
that are requested
in terms of SAGIS’
mandate as an
objective and
reliable provider of
information.
Since there are
currently no
statutory measures
regarding the
registration of
sellers, importers
and exporters of the
products in
question, and since
the Maize and Wheat
Forums have argued
that information to
be obtained in terms
of the proposed
statutory measures
is deemed to be
essential for the
market to operate
effectively, the
forums agreed to
propose:

That each seller,
importer or exporter
of animal feed,
maize products and
wheaten products
should keep complete
records for each
calendar month in
respect of the
products, sold,
imported or exported
for commercial
purposes; and
·
That sellers,
importers and
exporters should,
within 10 working
days from the end of
each calendar month,
submit to SAGIS an
accurate prescribed
return in respect of
animal feed, maize
products and wheaten
products sold,
imported or
exported;
·
Furthermore every
seller and exporter
of animal feed
should, within 10
working days from
the end of each
calendar month,
submit to SAGIS an
additional accurate
prescribed return in
respect of animal
feed raw materials
added to or used in
the production or
manufacturing of
animal feed.
The forums argue that information
on the sale, import
and export of the
products in question
is crucial for the
effective operation
of the markets and
market participants
to be able to plan
properly. The
supply of generic
market information
to all role-players
on a continuous
basis is therefore
essential. The
maintenance of macro
industry market
information is
regarded as critical
for strategic
planning by the
maize and wheat
industries, as well
as for directly
affected groups.
If approved, the
statutory measures
will come into
operation as soon as
approved by the
Minister of
Agriculture,
Forestry and
Fisheries, for a
period of four
years.
Directly affected
groups in the grain
and oilseeds
industries are
kindly requested to
submit any comments
regarding the
proposed statutory
measures to NAMC in
writing before 7
March 2014.

AMENDMENT OF
REGULATIONS TO
GENETICALLY MODIFIED
ORGANISMS ACT, 1997
(With effect from 1
April 2014)
A notice has been published to amend
the regulations to
the Genetically
Modified Organisms
Act 15 of 1997
with effect from
1 April 2014.
Various fees that are payable in
terms of table 2
have been increased.
A fee of R470 will be payable for
the importation and
exportation of
genetically modified
organisms.

AMENDMENT OF
REGULATIONS TO
LIQUOR PRODUCTS ACT,
1989
A notice has been published to amend
the regulations to
the Liquor Products
Act 60 of 1989.
The table of fees payable in terms
of section 27 (1)
(k) has been
amended.
Various new fees will apply in
respect of the
application for
import certificates,
analysis of samples
of products intended
for import,
application for
removal certificates
in respect of
imported products,
application for
export certificates,
etc.

LIQUOR ACT 59 OF
2003: NATIONAL
LIQUOR NORMS AND
STANDARDS
(Comments due by 11
March 2014)
The South African
National Minister of
Trade and Industry,
in terms of the
Liquor Act, 59 of
2003, and in
consultation with
the National Liquor
Policy Council
published a notice
to extend the period
for public comments
with regard to the
National Liquor
Norms and Standards
until 11 March 2014.
To
ensure compliance
with the tax laws of
South Africa, all
registrants or
licensee holders
should be registered
with the South
African Revenue
Services (“SARS”) in
terms of the Income
Tax Act and the
proposed Customs and
Excise Duty Acts.
The National Norms and Standards are
additional to any
other existing
conditions outlined
in the Liquor Act,
59 of 2003 and any
provincial or
relevant statute.
They will apply
automatically to new
applications or
reviewed licenses.
The manufacturing, distribution and
retail of liquor
products should
comply with all
relevant legislation
as and when amended.
This shall include:

Products Act 60 of
1989;
·
Counterfeit Goods
Act 37 of 1997;
·
Provincial Liquor
Acts;
